Este pacto incluye a los presentes y a los ausentes, sus clanes, sus l\u00edderes y miembros\u201d<\/span> .<span style=\"color: #000000;\"> [Al Baihaqui]<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><span style=\"color: #000000;\"> <\/span><br \/><span style=\"color: #0000ff;\">El tratado del Profeta <\/span><\/span><\/span><span style=\"font-family: times new roman,times;\"><span style=\"color: #0000ff;\"><span style=\"font-size: large;\">(la paz y las bendiciones de Al-lah sean con \u00e8l)<\/span><\/span><\/span><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><span style=\"font-family: times new roman,times;\"><span style=\"color: #0000ff;\"> con Bani Damurah<\/span><\/span><\/p>\n<p>Otro de los pactos celebrados durante la vida del Mensajero de Al-lah <\/span><\/span><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\">(la paz y las bendiciones de Al-lah sean con \u00e8l) <\/span><\/span><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\">, fue el que se firm\u00f3 con Bani Damurah (una subdivisi\u00f3n de la tribu de \u2018Adnan, la cual viv\u00eda en Widan, al oeste de Medina), que ten\u00eda como jefe a Majshi ibn \u2018Amr Ad-Damuri.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><br \/>El Profeta <\/span><\/span><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\">(la paz y las bendiciones de Al-lah sean con \u00e8l)<\/span><\/span><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"> tambi\u00e9n firm\u00f3 un pacto con Bani Mudlai, que viv\u00edan en el \u00e1rea de Yambu\u2019 en el segundo a\u00f1o de H\u00e9gira. \u00c9l hizo lo mismo con las tribus de Yuhainah, que eran grandes tribus que viv\u00edan en la parte noroeste de Medina [6].<br \/>Y no podemos dejar de mencionar uno de los tratados m\u00e1s importantes que se firmaron en la historia isl\u00e1mica, nos referimos al pacto del Hudaibiah, el cual, mientras dur\u00f3, trajo prosperidad a Medina y la Da\u2019wah avanz\u00f3 grandemente por la Pen\u00ednsula \u00c1rabe.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><br \/><span style=\"color: #0000ff;\">El Tratado de Omar<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><br \/>Entre los tratados isl\u00e1micos se encuentra tambi\u00e9n el pacto hecho por el l\u00edder de los creyentes <span style=\"color: #800080;\">Omar ibn Al-Jattab<\/span>, que Al-lah est\u00e9 complacido con \u00e9l, con la gente de Ilia\u00b4 <span style=\"color: #800080;\">(Jerusal\u00e9n)<\/span>. Dicho tratado fue llamado <span style=\"color: #800080;\">\u201cel Pacto de Omar\u201d<\/span>.<br \/>Estos y muchos m\u00e1s pactos que contrajeron los musulmanes con sus vecinos y naciones extranjeras, son una prueba fiel y viva de que los musulmanes trataron de vivir en una atm\u00f3sfera calmada y pac\u00edfica con sus vecinos, y de que ellos nunca buscaban el combate y los conflictos, al contrario, siempre prefer\u00edan la paz en vez de la guerra, y la concordia en vez de la discordia.<\/p>\n<p><span style=\"color: #0000ff;\">Reglas y condiciones de tratados en el Islam<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><br \/><span style=\"color: #008080;\">El Islam ha establecido reglas y condiciones para los tratados, para asegurarse de que ellos concuerden con la Shari\u2019ah y sus objetivos.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><span style=\"color: #008080;\"> <\/span><br \/>El Imam Mahmud Shaltut , que Al-lah lo tenga en Su misericordia, dijo: \u201cCuando el Islam les dio a los musulmanes el derecho de firmar tratados para alcanzar los objetivos que ellos consideraban necesarios, estableci\u00f3 tres condiciones para garantizar la validez de estos, estas condiciones son:<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><br \/>\u2022En primer lugar, los t\u00e9rminos deben ser acordes a lo establecido por la Shari\u2019ah y no deben ir en detrimento de sus leyes b\u00e1sicas y generales. Esto fue mencionado en el dicho del Profeta (la paz y las bendiciones de Al-.lah sean con \u00e8l)<\/span><\/span><span style=\"font-family: times new roman,times;\"><span style=\"font-size: medium;\"> <\/span><\/span><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\">: <span style=\"color: #008080;\">\u201cToda condici\u00f3n no incluida en el Libro de Al-lah es inv\u00e1lida\u201d<\/span> <span style=\"color: #000000;\">[Bujari]<\/span>.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><br \/>\u2022En segundo lugar, el tratado debe de ser basado en la buena voluntad de las dos partes. No es aceptado ning\u00fan pacto que haya sido firmado por la fuerza; por lo tanto, lo que se pacte debe ser satisfactorio para ambas partes, sin que se pierda u olvide el primer principio antes mencionado.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"><br \/>\u2022En tercer lugar, el tratado debe englobar objetivos y rasgos claros, y definir obligaciones y derechos de una manera que no deje espacio para interpretaciones err\u00f3neas y para juegos de palabras. La raz\u00f3n por la que fracasan los tratados se debe a la ambig\u00fcedad con la cual una de las partes pretende sacar partido de la otra, dejando grietas por donde pueda entrar y lograr los objetivos que se ha propuesto desde el principio y sin que le importe en realidad la armon\u00eda y la paz.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: times new roman,times;\"><span style=\"font-size: large;\"> <span style=\"color: #000000;\">Al-lah, Glorificado sea, dijo (lo que se interpreta en espa\u00f1ol)<\/span>: <span style=\"color: #008000;\">{No hag\u00e1is juramentos fraudulentos, pues resbalar\u00e9is despu\u00e9s de haber pisado firme.
